The lawyer for a Memphis woman whose 7-week-old daughter has been missing for five days says abuse and neglect charges against her should be dismissed, but he is preparing for the possibility that they could be upgraded to homicide.

Memphis police say Andrea Walker told them she left the baby at home with her 3-year-old son while she took her 5-year-old son to school Thursday. She says the baby was gone when she returned.

Police searched three days before suspending their search Saturday.

Police charged Walker after interviewing her, saying in an affidavit the baby may have suffered "serious bodily harm."

Defense lawyer Leslie Ballin asked at a Monday hearing that bond be reduced from $500,000 to $25,000. A judge set a Jan. 21 hearing on the motion.
