BUFFALO, N.Y. – A lawyer for a man charged with opening fire on a crowd outside an upstate New York restaurant says a videotape shows a second shooter and an exchange of gunfire outside the restaurant on the night four people died.
Attorney Earl Key brought up the video during a hearing Monday to determine whether shooting suspect Riccardo McCray's statements to authorities should be allowed at trial.
Prosecutor James Bargnesi (bar-NAY-see) objected when Key mentioned the video while questioning a Buffalo homicide detective and the topic was changed. Bargnesi wouldn't comment afterward. Key couldn't be reached by phone.
The hearing continues Tuesday.
McCray faces first- and second-degree murder charges for the shooting Aug. 14 outside City Grill in Buffalo. Four other people were wounded.
